States Bet on Cameras—Drivers May Pay the Price
States are continuing to expand automated traffic enforcement and license plate reader networks, prompting renewed debate over roadway safety, citation costs, data collection and police access to vehicle records. While transportation officials often describe the technology as a tool to reduce crashes and identify vehicles, privacy advocates and some lawmakers are raising concerns about how broadly the systems can track drivers.
Automated enforcement continues to expand
Red-light and speed cameras are spreading across additional states and communities. A bill awaiting action from the California governor could authorize speed cameras on more roads, adding to the state’s growing use of automated enforcement.
The Owner-Operator Independent Drivers Association has said road safety should remain the primary objective of traffic enforcement. The organization has criticized systems that produce a continuing flow of citations and fines without clear evidence that they are reducing crashes.
Revenue from automated citations is typically divided among state and local governments and private technology vendors. In one program, city officials said slightly more than half of drivers paid their citations. The state received half of that revenue, while the vendor collected approximately one-third of the remaining amount.
License plate readers raise privacy concerns
Automatic license plate readers, or ALPRs, record vehicle plates and other visible details as vehicles pass cameras positioned along public roads. The data can be searched to identify vehicles, examine travel patterns and assist law enforcement investigations.
Privacy advocates say the technology can reveal far more than whether a vehicle is connected to a specific investigation. Searches may include a vehicle’s color, make, bumper stickers, items visible through the windows and other identifying characteristics. Critics argue that long-term access to this information can create a detailed record of a person’s movements, including visits to homes, houses of worship, political gatherings and protests.
Flock Safety, one of the largest companies in the market, has faced increased scrutiny from lawmakers and civil liberties advocates. The company’s technology has expanded beyond traditional plate searches, including tools that can identify vehicles based on descriptions and other visual details. Its reported work involving live video, drones and suspect-following capabilities has added to concerns about the scope of the systems.
Misuse cases draw official scrutiny
Several reported incidents have intensified questions about oversight. In Fort Bend County, Texas, a sheriff’s deputy was suspended after allegedly searching one person’s license plate 41 times and another plate 148 times. A Pasadena police sergeant resigned after allegedly using Flock technology to track and stalk another officer, although prosecutors did not pursue charges. The Deer Park Police Department also reported that an officer was suspended after admitting to misusing the system.
Officials in Tempe, Arizona, said misuse of the cameras had raised concerns about the risks associated with the technology. Some local officials have acknowledged public anger over the systems while noting that contracts with camera companies may fall outside their direct authority.
Lawmakers seek limits on government access
ALPR companies are facing greater scrutiny in Washington as lawmakers examine how artificial intelligence and increasingly sophisticated search tools affect drivers’ privacy. A group of House Republicans led by Rep. Tim Burchett, R-Tenn., has introduced legislation that would prohibit the federal government from purchasing Flock cameras or similar technology.
Sen. Bernie Sanders, I-Vt., has also criticized the expansion of Flock’s camera network, saying the company has installed nearly 100,000 cameras across the country. Rep. Brian Harrison, R-Texas, said he was not aware of discussions about using a state fee increase to fund license plate readers. Harrison has introduced legislation that would require a warrant before police could access license plate reader data.
As more communities adopt automated enforcement and vehicle-tracking systems, the debate is shifting toward how long data should be retained, who may access it and what safeguards are required when the technology is misused.
